DO YOU KNOW THE LAW?

The Toxic Substances Control Act contains two rules that are critically important to the remodeling and home improvement industry: the Pre-Renovation Lead Information Rule ("PLIR”) and the Lead Renovation, Repair and Painting Rule (“RRP”).

PLIR requires contractors doing renovation work to provide the Environmental Protection Agency's ("EPA") PLIR pamphlet, "The Lead-Safe Certified Guide To Renovate Right" to the owner (and any tenant) of pre-1978 housing where work is being done. This disclosure requirement covers most residential home improvement jobs, including all window replacement work - contrary to what many attorneys believe.

Separately from PLIR, RRP requires contractors doing renovation work to have their company certified by EPA (or an EPA-authorized state), use certified renovators who are trained by EPA-approved training providers, and follow lead-safe work practices while performing the renovation.

Non-compliance with either rule can mean penalties ranging up to $43,611 per violation, per day. One mid-size contractor is currently faced with over $10 million in fines from the EPA. Surprised you never heard of this?
